The federal government recognizes the environmental risk that is inherent in every
property transaction. Even if a property has never had an environmentally sensitive
use on it, there is a virtual certainty that some property within ¼ mile, ½ mile or
farther away had, has or will have an environmental incident, and contamination can
travel through soil or groundwater to yours. If contamination is discovered on your
property regardless of where it originated or when, you will likely be liable for the
full cost of cleanup, unless you can document there was no contamination on the date
you took possession.
To assure you will qualify to apply for environmental liability
protection should it ever be necessary to do so, I include vapor investigation as part
of every Phase 1 Environmental Assessment and if necessary to assure you will qualify,

PCA Property Condition Assessment
For every type of commercial, industrial, institutional and multi-unit
residential real estate including retail, hotel, medical, educational, airport, marina, manufacturing,
warehouse and distribution property and more, I perform Property Condition Assessment (PCA) in conformance
with ASTM E-2018-15 Standard Guide for Property Condition Assessments: Baseline Property Condition
Assessment Process, which is the current and highest standard for property condition assessment.
Property Condition Assessment includes inspection of building structure including foundation, exterior
and interior walls, doors, windows; building systems including insulation, electrical, plumbing and HVAC
including furnaces, boilers and air conditioning and exterior and interior finishes.
Assessment also includes landscaping, parking, driveways and site amenities.
I always include estimates of necessary and recommended repairs and upgrades and can also provide
a Capital Reserves Table of annual budget amounts to cover required repairs, replacement, upgrades over
the next 10 years of ownership or lease. This feature allows the user and/or lender to project up to
10 years of costs for budgetary purposes.
Unlike a standard building inspection Property Condition
Assessment includes sidewalks, driveways and parking areas, landscaping and site amenities. A tier 1
ADA survey is also included.

Low Cost Environmental Records Search and Risk Assessment
Low cost sites or sites perceived
as being at very low risk of contamination may
qualify for Enhanced Environmental Records Search & Risk Assessment. This form of assessment is often called
Preliminary Phase 1 but is sometimes the only assessment certain sites need. We dramatically improve report outcomes
by adding a geology/hydrology investigation to the standard inquiries. Our proprietary protocol exceeds industry
standards and requirements of Small Business Administration SOP 50 10 5(E) for eligible property types.
This form is often suitable for low price property and property perceived to be at very low risk for environmental
contamination. For industrial and commercial property and any property perceived to be at moderate to high risk for
contamination either generated onsite or on adjoining or nearby sites RSRA may be an effective pre-offer screening strategy.
When an offer is subsequently made and full Phase 1 Environmental Assessment is required, the entire RSRA fee is credited to
the standard Phase 1 fee.

Vapor Encroachment Screening
The new ASTM E 1527-13 Phase 1 Environmental Assessment Standard that went into effect on November 6, 2013
clarifies that a vapor investigation is necessary for you to meet all the standards of All Appropriate Inquiry (AAI) as defined by federal
statute 40 C.F.R. § 312.21(C)(1)to qualify to apply for liability protections should it ever be necessary to do so.
- To qualify user for federal environmental liability protection - innocent landowner or innocent purchaser defense 42 U.S.C. §§ 9607(b)(3)
and 42 U.S.C. §§ 9601(35) should it ever become necessary.
- To qualify user for federal environmental liability protection - contiguous property owner liability protection 42 U.S.C. § 96079(q) should
it ever become necessary to do so.
- To qualify user for federal environmental liability protection - bona fide prospective purchaser liability protection 42 U.S.C. § 9607(r)
pursuant to the Small Business Liability Relief and Brownfields Revitalization Act, Pub. L. No. 107-118 (2002), 42 U.S.C. §§ 9601 et. seq
Some form of vapor investigation is necessary to qualify a user for any of the CERCLA environmental liability protections and applications for
liability protection have and will be denied for lack of vapor investigation prior to time of purchase. Whenever a vapor encroachment condition is
detected or suspected by the standard vapor investigation we perform ASTM E-2600-10 Standard for Vapor Encroachment Screening because ASTM E 2600-15
is the only published and recognized screening methodology because it can be replicated. At USA Due Diligence Services this is a value added service
at no additional charge.
Vapor intrusion is a real business environmental risk. Over the past several years, there's been a growing body of evidence that chemicals
can penetrate building foundations at levels that raise health concerns for the occupants. There have been increasing numbers of lawsuits involving
vapor intrusion issues. According to an Environmental Bankers Association survey, vapor intrusion issues affect loan approvals for commercial,
industrial, institutional real estate-secured lending, commercial lending and multi-unit residential lending, and also trust activities.
If a vapor encroachment condition exists, Phase I Environmental Assessment without a vapor investigation component does meet the ASTM 1527-13 Standard
and does not satisfy the requirements of All Appropriate Inquiry (AAI) to qualify user to apply for federal environmental liability protections.
Contamination can travel as liquid, solid or vapor through soil and groundwater from a contamination source on site or off site within ASTM Standard search distances.
This is true even after contamination has been mitigated and only negligible levels of liquid or solid contamination remain. Vapor encroachment is known to be a significant
hazard and at least 32 states so far are now reopening all closed soil and groundwater contamination No Further Action (NFA) cases and where vapor contamination is found
the current owner becomes liable for remediation costs. A vapor investigation is required at time of purchase for every property type.

Some sites are hard to get to but we’ve never failed to show up on site, no matter how hard it was to get there.
We’ve traveled thousands of miles to remote areas when no other provider was willing to
travel even a couple of hundred miles from the nearest major city. We’ve travelled to peanut farms in Alabama
and to the odd tool and die or other manufacturer with government contracts in Texas or Oklahoma or
bought up by a national or multi-national corporation, or funded by a national or international investor or lender.
We regularly work in seaside, mountainous and other resort areas to hospitality and recreational venues including
hotels, restaurants, ski areas, marinas, and camp and conference centers in California, Texas, Nevada, Florida, Michigan
and in the Catskills Of New York where we’ve completed Phase 1 Environment Assessment Reports on sites ocean side,
river front, desert and mountain top and valley.
One of our most unusual “commute” was to Fire Island, New York which as it turns out is accessible only by passenger
ferry. So when the GPS lady said “turn left onto the ferry” she meant “park in the lot, purchase a ticket and walk onto the
ferry – when it arrived at the dock.” There are no private automobiles on the Island, travel is by foot, bicycle or golf cart.
While there are year-round residents Fire Island is mostly a summer resort community.
We regularly travel by owned car and large and small airplanes and rental cars. In San Francisco, Chicago, Atlanta,
Washington, DC, Boston and New York we use rapid transit including high speed rail, subway, streetcar and trolley.
And we’ve worked places so remote we’ve had to hike in. In Florida we once arrived at an address to find much of the
property was ponds and swampland where nine alligators lived. The owner was kind enough to provide us with an ATV.
The owner neglected to mention the alligators until the end of day. Not sure how we feel about that, but we’re alive to tell
the story so it’s all good.
